Planning permission granted on appeal for up to 90 dwellings at Evercreech Mendip District for The Silverwood Partnership.  The decision challenged the Council’s ability to demonstrate a 5 year supply of housing land as well as the emerging Local Plan’s housing provision.  The Council conceded that it could not demonstrate a 5 year supply of deliverable housing land and withdrew their reasons for refusal.  In addition they accepted that their emerging Local Plan was not sound in respect of housing strategy.

Acting on behalf of London & Cambridge Properties who own the Brighton Hill District Centre in Basingstoke, an appeal by Tesco was dismissed for a Class A1 foodstore on land at The Harrow Way.  The appeal was dismissed due to evidence submitted that it would adversely impact on the vitality and viability of the District Centre.

Appeal allowed for the change of use from retail (Class A1) to Class A2 at 242 Station Road, Harrow.  The proposal breached the percentage for non retail uses in a primary shopping frontage but the Inspector considered that the economic benefits outweighed the policy.

Planning permission granted for the erection of a block of 4 apartments at 242-246 Station Road, Harrow for L&CP.

Appeal allowed for the erection of 53 dwellings on land at Sleep Lane, Whitchurch for Barratt Bristol together with a potential award for costs.  The Council could not demonstrate a 5 year supply of deliverable housing and also could not demonstrate that the Whitchurch bypass would be delivered within a reasonable timescale.
